Slowest Installation In History

I called Joe and he was at the property installing the cabinets. Still. I don't know what he was doing all day Friday and Monday, but apparently it wasn't finishing my job. Anyway, he said he was installing the remainder of the cabinet bases now. Next comes the countertops, then the upper cabinets in the kitchen. He did mention my handyman was there working on the toilet (that just doesn't sound right...) but they would not be in each other's way. This is good news for two reasons: the first, obviously, is that they won't be in each other's way :-) But the second is that this provides proof that Joe is actually working at the house. I did not tell Joe about the handyman doing some additional work, so the only way he would know is if he was there and ran into him. It's sad when you don't trust what your contractors are telling you, but this is the position Joe has put me in. The estimated cabinet completion date is tomorrow, but who knows when it will actually be. I fully expect to have Joe tell me that the bathroom cabinets will be delayed because the handyman is putting down new flooring. (Although, if he's working on the toilets now, I would think he already put down the new flooring.)

I NEVER trust what our contractors tell us anymore. In fact, I try to make it my business to find out what ELSE they're working on in order to determine what's really going on.

Steve - No, he doesn't mention the discount anymore and I haven't mentioned it. We are at the point where he owes me more than I paid him. Once everything is installed, I am going to change the lockbox code so he can't get back in, then send him a bill for what he owes me along with a copy of the contract. I'll send this via certified mail, return receipt to give it an added punch. I don't think I'll get anything from him, but I want him to know I haven't forgotten and I'm still pissed about it. My bottom line right now is to get the job completed as soon as possible.

He already paid him buddy - he has every right to do what he plans.

The previous commenter is correct. He was paid in full over 2 months ago. His original contract stated the job would be done in 10 working days. After several extensions, he agreed, in writing, to pay me $100 per calendar day for each day after May 18 that the job was not done.

Ok, something bugs me. You said he's installing the counters and then the upper cabinets. You are suppose to install the uppers first and then the counters. What if he drops an upper onto the countertop? Is he going to stand on your new counters to install the uppers? Has this guy even installed cabinets before?

OK, I didn't realize that he had already been paid in full.

Regardless, the penalty clause is still most likely unenforceable. With the proper contractual language, however, you could make the clause have more bite.
